Renters' Protection Act Passes House

Ohio Renter’s Protection Act Passes House
Reps. Celeste & Foley Pleased by Bipartisan Vote

COLUMBUS – State Representatives Ted Celeste (D-Grandview Heights) and Mike Foley (D-Cleveland) today announced the House of Representatives’ approval of the their co-sponsored Ohio Renter’s Protection Act (Sub. House Bill 9). “Every day, Ohioans are evicted from their homes because their landlord did not remedy a foreclosure,” Rep. Celeste said. “The House’s favorable vote today puts us one step closer to ensuring tenants who pay their rent on time and live up to their end of the contract are not immediately evicted.”

“The Renter’s Protection Act will not only help Ohioans who find themselves caught up in a rental foreclosure, it will also help stabilize our communities and reduce blight by allowing the month-to-month contract continuation,” Rep. Foley added. “We hope our colleagues in the Senate act swiftly to pass House Bill 9.”

The Renter’s Protection Act would:

1. Require landlords to notify potential tenants if the property they are renting out is currently in foreclosure.

2. Require landlords to notify all current tenants residing in any building if that property goes into foreclosure (within 60 days of the foreclosure filing).

3. Require landlords to notify tenants if a foreclosure is not remedied and a sheriff’s sale date is set (21 day notice before sale date). This gives the tenant an equal opportunity to bid on the property at the sheriff’s sale.

4. Stipulate that all residential rental agreements convert to a month-to-month rental agreement upon court approval of the sale of the property. This allows the renter at least 30 days to find a new home, compared to the current law which only gives three days notice before eviction.

Sub. House Bill 9 now moves to the Ohio Senate for consideration.
